现代转型视域下村规民约发展的困境与对策研究

      村规民约是深化村民自治的重要载体，对于践行基层民主和实现乡村有效治理意义重大。但传统的村规民约在与现代社会融合的过程中暴露出诸多弊端，需要完成现代转型才能成为国家治理中的重要一环。在转型过程中，村规民约的功能逐渐式微，主要体现在村规民约的制定主体缺失、作用机制搁浅以及监督机制不健全，导致村规民约的体制机制在一些地方基本处于瘫痪状态。究其原因，发现现代转型中村规民约的实施基础、制定依据和价值目标与传统村规民约相比发生了改变。鉴于此，结合村规民约现实困境产生的原因，认为应当增强村民主体意识，促进村规民约制定程序的合法化；塑造乡村社会法治文明，推动村规民约本质属性回归；推动全方位监管，强化村规民约内外监督机制，以此推动村规民约实现现代转型。

      Village rules and regulations are important to deepen villagers' autonomy, which is of great significance to the practice of primary-level democracy and the realization of effective rural governance. However, traditional village rules and regulations have exposed drawbacks in the process of integrating with modern society, which requires the completion of modern transformation to become an important part of national governance. In the process of transformation, the functions of village rules and regulations gradually decline in some places, which are mainly reflected in lacking decision-making body, incomplete function mechanism and imperfect supervision mechanism. The reason is that the implementation basis, formulation basis and value target of village rules and regulations in modern transformation have changed compared with that of traditional village rules and regulations. In this regard, it is suggested to strengthen the villagers’subject awareness to promote the legalization of formulation procedure, shape the legal civilization of rural society to promote the return of essential attribute; promote all-round supervision to reinforce internal and external supervision mechanism, so as to promote the modern transformation of village rules and regulations.
